Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and SellSmart ("we," "us" or "our"), concerning your access to and use of the SellSmart website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").

2. Eligibility

By using the Site, you represent and warrant that:

  • You are at least 18 years of age.
  • You are the sole and absolute owner of any device you sell to us.
  • You have the legal right to sell the device.
  • The device is not stolen, lost, or subject to any liens or encumbrances.

3. Device Description & Grading

You agree to accurately describe the condition, specifications, and functionality of the device you wish to sell. Our grading criteria (Flawless, Good, Fair, Broken) must be followed honestly.

Upon receipt, we will inspect your device to verify its condition. If the condition matches your description, we will pay you the quoted amount.

4. Re-Quote Policy

If our inspection determines that the device condition differs from your description (e.g., you selected "Good" but the screen has deep scratches, or the model is different), we will provide a Revised Offer via email.

  • Accept: If you accept the Revised Offer, we will process payment immediately.
  • Reject: If you reject the Revised Offer, we will ship your device back to you free of charge.
  • No Response: If we do not receive a response to our Revised Offer within 7 days, we reserve the right to process the device at the revised price or return it to you at our discretion.

5. Stolen Devices

We check every device against national stolen device databases (such as CPIC and GSMA). If a device is reported as lost or stolen, we are legally required to hold the device and notify law enforcement. We will not pay for or return any device reported as stolen.

6. iCloud / Google Locks

All devices must be removed from iCloud (Find My iPhone) or Google Account locks before shipping. We cannot purchase or process locked devices. If we receive a locked device, we will contact you to remove it remotely. If it cannot be unlocked within 5 days, we will return the device to you.

7. Payment

Payment is issued via Interac e-Transfer or PayPal after the device has passed inspection. We are not responsible for delays caused by incorrect email addresses provided by you.

8. Shipping & Risk of Loss

We provide a prepaid shipping label for your convenience. You are responsible for packaging the device securely to prevent damage during transit. We are not liable for devices that are damaged due to poor packaging. We recommend obtaining a receipt when dropping off your package at Canada Post.
